By creating an account or using The K✦Gem (the "Service"), you agree to these Terms of Use, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service. We may update these Terms; for material changes we will provide notice or ask you to re-accept.
You must be at least 13 years old, and some features may require you to be 18 or the age of majority where you live. Minors may use the Service only with a parent or guardian's consent. Your account information must be accurate.
You are responsible for safeguarding your account and password and for all activity under your account. Notify us immediately of unauthorized use.
You retain ownership of content you submit. You grant LiaVia, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content to operate and promote the Service. You represent that your content is lawful and does not infringe third-party rights.
Listings, reviews, ratings, and events are largely user-generated. We do not verify, endorse, or guarantee their accuracy, safety, or legality. Use your own judgment before visiting or transacting. A business "claim" does not imply our endorsement.
You must follow our Community Guidelines. Prohibited conduct includes fake accounts/reviews, paid or coordinated reviews, impersonation, harassment, hate, doxxing, defamation, illegal content, IP infringement, scraping, and interfering with the Service or its security. Violations may result in content removal and account suspension or termination.
We may review, hide, or remove content and restrict, suspend, or terminate accounts, in our discretion and without prior notice, including via automated systems. You can appeal a moderation decision at support@thekgem.com.
The Service integrates third-party services (maps, external links, payments). We are not responsible for third-party content or conduct, which carry their own terms.
Where paid features are offered, the displayed prices and terms apply; fees may be non-refundable except as required by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIAVIA, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR USD $100.
You agree to defend, indemnify, and hold LiaVia, LLC harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your breach of these Terms.
You may delete your account at any time. We may suspend or terminate access for violations or to protect the Service. Provisions that by their nature should survive will survive.
These Terms are governed by the laws of the State of Delaware, USA. You agree to first try to resolve disputes informally by contacting us. To the extent permitted by law, disputes will be resolved by individual binding arbitration, not a class action, and you waive participation in a class action.
If any provision is invalid, the remainder stays in effect. These Terms are the entire agreement regarding the Service. LiaVia, LLC may assign its rights and obligations.
